DMCA Policy
TikTok Creative Center respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to notices of alleged copyright infringement that are properly provided to our designated Copyright Agent.
This policy describes the information that should be included in a notice of alleged copyright infringement and how TikTok Creative Center will respond. It also outlines the process for submitting a counter-notification if you believe your content was wrongly removed.
Filing a Notice of Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content hosted on TikTok Creative Center infringes upon your copyrights, you may submit a notification of claimed infringement to our designated Copyright Agent. Your notice must be in writing and include all of the following information:
- Identification of the copyrighted work claimed to have been infringed: A description of the copyrighted work, and if available, a copy or the URL of an authorized version of the work.
- Identification of the material that is claimed to be infringing: A description of the material that you claim is infringing and sufficient information to permit us to locate the material on TikTok Creative Center (e.g., specific URLs or other unique identifiers).
- Contact information of the complaining party: Your full legal name, mailing address, telephone number, and email address.
- A statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- A statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Upon receipt of a valid DMCA notice, TikTok Creative Center will take appropriate action, which may include removing or disabling access to the allegedly infringing material.
Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification of the material, you may submit a counter-notification to our Copyright Agent. Your counter-notification must be in writing and include all of the following information:
- Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL(s)) at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which TikTok Creative Center may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Electronic or physical signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, TikTok Creative Center will forward a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against you within 10-14 business days, TikTok Creative Center may replace or restore access to the removed material.
